Statement by Abigail Moyo, spokesperson of the trade union UASA:

UASA welcomes the Constitutional Court order putting an end to the continuous attempts by the National Employers’ Association of South Africa (Neasa) and the South African Engineers’ and Founders’ Association (Saefa) at hampering the effective extension and implementation of the Metal and Engineering Industries Bargaining Council’s (MEIBC) consolidated main collective agreement. The consolidated current main agreement will lapse on 30 June 2024.

Neasa and Saefa initially launched an application to the Labour Court, but the application was dismissed, given the court’s view that there were no reasonable prospects of success in the application.

UASA believes collective bargaining to be a cornerstone of South African labour law that achieves parity and industry stability where plant level negotiations and potential ad-hoc strikes are avoided.
