Statement by Abigail Moyo, spokesperson of the trade union UASA:

UASA commends President Cyril Ramaphosa’s decision to refer the Copyright Amendment Bill (“CAB”) and the Performers’ Protection Amendment Bill to the Constitutional Court in accordance with Section 79(4) (a) of the Constitution.

This proactive step allows South Africa’s apex court to thoroughly review the Bills, with all eleven judges carefully considering oral and written submissions from civil society, interest groups, government and the private sector.

The Constitutional Court’s mandate to assess comprehensive input from diverse stakeholders will be critical in determining whether the Bills align with constitutional guarantees and protections. UASA recognises this process as essential to ensuring that the rights and interests of all parties involved, particularly those represented by UASA’s Arts and Entertainment Sector are upheld.

While some proponents of the CAB may find the delay disappointing, this approach minimises the risk of prolonged legal challenges. By seeking clarity from the highest court, the President has selected a route that promotes stability and certainty, benefiting all stakeholders and reducing the likelihood of future individual court disputes.

UASA has been closely monitoring the progression of these Bills since 2016 and believes that this as a pivotal step in securing a balanced approach that respects the rights of all parties involved.
